Ley impulsada por el PAC y Frente Amplio fue aprobada en segundo debate

San José (elpais.cr) - Tras varios años de discusiones y arduas negociaciones, con el voto unánime de 49 diputados fue aprobada en segundo debate, a ley que prohíbe el otorgamiento de permisos y concesiones para exploración y explotación de minería metálica a cielo abierto en Costa Rica.

Además, prohíbe el uso de sustancias tóxicas como el cianuro y el mercurio en la actividad minera, (expediente 15.948), el cual fue impulsado por el Frente Amplio, cerrando de una vez por todas el "portillo" legal para el desarrollo de estas prácticas insostenibles en Costa Rica.

José María Villalta Flórez-Estrada, diputado del Frente Amplio, señaló que "no se prohíbe la minería subterránea, pero se libera al país de la forma de minería más devastadora que existe: la minería metálica a cielo abierto, la que por las condiciones geológicas del país más está amenazando nuestras fuentes de agua, nuestros bosques y nuestra biodiversidad. Es claro que esto no es suficiente. Pero en comparación con el escenario actual resulta innegable que se trata de un progreso".

Villalta Florez-Estrada considera que "si la concesión de la compañía minera en Crucitas se cae en los tribunales contencioso-administrativos o el Gobierno la revoca, la transnacional minera no podrá obtener una nueva concesión ni revivir la anulada. Tampoco podrá pedir una prórroga del plazo".

Aseguró que "en última instancia, esta reforma le cierra las puertas a decenas de concesiones mineras que están en trámite, en la zona Norte y en el resto del país. Hoy estos trámites están frenados por el decreto de moratoria, pero, como pasó al inicio del Gobierno de los Arias, dicha moratoria puede eliminarse fácilmente con otro decretazo nocturno".

"Como lo hemos señalado en anteriores ocasiones, el gobierno debe ser consecuente y aprovechar este momento para derogar el Decreto Ejecutivo número 34801-MINAET que declaró de interés público y conveniencia nacional el Proyecto Minero Crucitas", indicó el diputado Villalta,

Por su parte, el opositor Partido Acción Ciudadana (PAC), celebró la declaración de Costa Rica como país libre de Minería de Metales a Cielo Abierto, pero advirtió que no obstante, el proyecto de Crucitas sigue siendo una amenaza para el país, por lo que llamó a la población a no bajar la guardia.

"La Fracción de Acción Ciudadana celebró la aprobación de esta iniciativa en virtud de que este tipo de minería tiene efectos ambientales y sociales negativos, especialmente en los territorios ambientalmente frágiles", agregó.

Un boletín del PAC aseguró que la organización presentó el proyecto a la corriente legislativa el 5 de julio de 2005 por iniciativa del ex diputado (2002-2006), Gerardo Vargas Leiva.

"Hoy damos un paso en la dirección correcta declarando de manera definitiva a Costa Rica libre de minería de metales a cielo abierto. No obstante, la lucha sigue pues el proyecto de Crucitas continúa siendo una amenaza. Reiteramos nuestro llamado al Poder Ejecutivo y a doña Laura Chinchilla para que se deje de escudar en pretextos y detenga de una vez por todas ese nefasto proyecto", aseguró el diputado Claudio Monge, gerente del tema ambiental para la Fracción del PAC.

Este proyecto de ley que adicionará un artículo 8 bis y modificación del inciso k) del artículo 103 del Código de Minería, Ley Nº 6797 de 4 de octubre de 1982 y sus reformas, Ley para declarar a Costa Rica país libre de minería y metales pesados a cielo abierto, pasará al Poder Ejecutivo para el trámite correspondiente.

El proyecto modifica el párrafo segundo y agrega ocho párrafos al artículo 8 del Código de Minería, con el fin de prohibir la explotación minera en los refugios de Vida Silvestre y crea la excepción a la prohibición de exploración y explotación minera en pequeña escala, para los trabajadores organizados en cooperativas de las localidades de Abangares, Golfito y Osa, en donde la subsistencia de las familias, depende casi exclusivamente de la extracción del mineral oro.

El proyecto modifica el artículo 103 inciso k) del Código de Minería, con el fin de considerar la técnica de lixiviación con cianuro y mercurio y el uso inadecuado de sustancias peligrosas, según calificación hecha por la Organización Mundial de la Salud, como factores que deterioran el ambiente.

La propuesta incluye siete transitorios, el primero da un plazo de diez años a las cooperativas para eliminar el uso de cianuro y mercurio en la explotación minera y pasar la actividad a prácticas amigables con el ambiente, así como un plazo de tres años al Estado para que promueva alternativas productivas sustentables que ayuden a aprovechar mejor el mineral extraído, para lo cual se les abre la posibilidad de tener acceso a créditos de manera prioritaria en la Banca de Desarrollo.

El segundo reconoce la preservación de los derechos de concesión adquiridos de buena fe, antes de la eventual aprobación de la ley.

El tercer transitorio referido a los permisos de extracción que se encuentran en trámite posterior a la eventual aprobación de la presente ley, los cuales deberán ser archivados.

El cuarto transitorio, advierte la imposibilidad de extender los permisos de exploración y extracción, posterior a su vencimiento.

Un quinto transitorio hace referencia al estudio que debe realizar el Ministerio de Ambiente, Energía y Telecomunicaciones (Minaet) del estado de las solicitudes pendientes, así como de los permisos y concesiones otorgadas en las áreas de reserva de Abangares, Osa y Golfito y cancelar y archivar aquellas que sean contrarias al principio de legalidad.

El sexto transitorio se refiere a la reglamentación que le debe dar el Poder Ejecutivo a lo que dispone la reforma al artículo 8 del Código de Minería contenida en el artículo 2 del proyecto de ley, contemplando la asistencia y los incentivos para el desarrollo de tecnología limpia y alternativas productivas.

Un último transitorio que se refiere a la reglamentación por parte del Ministerio de Salud y el Minaet sobre el almacenamiento, transporte, uso y manipulación del cianuro, mercurio y sustancias peligrosas en pro de la salud de la población trabajadora y de sus familias.

Por fin, después de años de arduas negociaciones, se logró votar hoy en segundo debate, de forma unánime, la ley que busca prohibir el otorgamiento de permisos y concesiones para exploración y explotación de minería metálica a cielo abierto en el territorio nacional, así como el uso de sustancias tóxicas como el cianuro y el mercurio en la actividad minera, (expediente 15.948), el cual fue impulsado por el Frente Amplio, cerrando de una vez por todas el “portillo” legal para el desarrollo de estas prácticas insostenibles en Costa Rica.

Last November our sewer line failed. It was scatcepular. We live in an old city suburb and the clay tiles just gave up. Because of complicating factors we put in an entire new sewer line and capped off the old. With all of the surprises that come with loving an old house our plumber honestly didn't know if it was all going to work even when he was done. With a daughter (smart like Hannah) preparing to go off to school, and a husband with a low paying job and a wife who is a consulting (anyone notice how bad the economy is?) we had no idea how we were going to swing it. We bit the bullet, refinanced our mortgage and included enough extra money in the refinance to replace our 90+ year old windows. Did I mention that we live on a county road and our yard is almost solid clay? The county required that the job be completed before snowfall (mid November in upstate NY we were already pushing it) while the asphalt could be laid. The town and county required a HUGE bond be held for 12 months to cover the road repaving. The entire winter our yard was a slippery, dangerous clay pit. Come spring we moved 12 yards of top soil to fill the holes left by the work.December 30 found us replacing 17 very drafty windows so we could take advantage of the energy rebate. The good news and there is good news is that our sewer line works like a dream. With two huge weather events this past year we were the ONLY house on our street that didn't flood. Our energy bills dropped with the new windows. And our daughter still got enough financial aid to attend Oberlin College. Life is scary. We are strong and we survive. You go Annie and Gerry!

Opera performers (and audiences) tend to go all out with style and flamboyance; Baroque performers (and audiences) tend not to consider fashion a big deal and are very low-key with their apparel. Ultimately, no, I don't think ensembles should be able to wear any colour; then it looks like a rehearsal.

We just had the sewer line done and all they did was route a smaller but more durable one through the existing line. All they had to dig was the spot in the street where we met the main line and up at the house (they also replaced the cleanout). Not sure if that’s an option for you but since it’s trenchless, I think it’s cheaper. Also was completed in one day and didn’t destroy my new landscaping, though one plant near the front door was in the way, alas.If you do have to go the medication route for your dog, see if your state allows your vet to write you prescriptions. Most vet meds, including antibiotics and steroids, also have human equivalents and hence can be filled cheaper at human pharmacies. My dog’s prednisone is the same cost as my co-pay for MY meds! Not all states allow it so hopefully MN does.Glad you’re still smiling!

Those are pretty high vet bills for the services you mentioned. At that rate the surgery, if required, will be very expensive. Have you looked into whether the clinic at the University’s vet school is more reasonable? I have had the extracapsular repair done on two dogs and it is very straightforward and easy to do. My vet does it in under 15 minutes (I get to watch). Recovery time is pretty speedy but will be a little longer for a dog Atticus’ size. Alternatively, if the cruciate is just torn and not completely sheared off, rest can work (although I think it’s harder on you and the dog in the long run).

WOW! When it rains it pour. I have a suggestion for Atticus. We have a 15 year old cat that has arthritis in her hips. She’s now on steroids that help quite a bit — I don’t know if they prescribe them for dogs — but they’re only about $16 a month. But what she really likes is her heated bed. I’ve put it right in front of a baseboard heater and she’s a happy cat. It seems to have loosened her hips as well.
